Photography Permission | Property Release

Professional work requires professional processes. That is why a Photography Permission is mandatory for us — and of course for you as well.

Only on the basis of this Photography Permission can we grant you the corresponding image rights and ensure that you can use the images and the 3D content correctly and in a legally secure manner.

We will send the Photography Permission to you together with the written quotation and ask for your signature upon acceptance of the offer. These are standard industry formulations.

Photography Permission | Property Release

As authorized representative of the owner or holder of the rights to the property and the objects contained therein (hereinafter collectively referred to as the "Property") or as owner of the Property, I, NAME OF CLIENT, hereby grant the photographer/filmmaker MESH IMAGES BERLIN – Florian Wagner, Kurfürstendamm 193 Haus E, D-10707 Berlin and their legal successors the irrevocable right to create photographs, video and 3D scan data (hereinafter collectively referred to as Capture Material) depicting the Property for this assignment. The Photography Permission encompasses all usage rights necessary for the comprehensive use and editing of the content by the photographer or by the authorized persons. The authorization shall remain valid beyond my death. The Photography Permission includes:

- Reproduction right
- Right to online use of the content
- Right of making publicly available
- Transmission and broadcasting right
- Right of distribution
- Right to edit the content

I consent that the Capture Material may be combined with other images, text and graphics, cropped and modified. I consent that all rights to the Capture Material belong to the creator of this material, the photographer/filmmaker MESH IMAGES BERLIN – Florian Wagner, Kurfürstendamm 193 Haus E, D-10707 Berlin and/or their legal successors without any temporal, geographical or content-related restrictions.

The permission to use the Capture Material applies in principle for any purpose, in particular for advertising and marketing purposes and for commercial use within the scope of the joint work with the photographer. Use of the content is permitted in all contexts, with the exception of pornographic or defamatory contexts.

My personal data may not be made publicly available, but may only be used as necessary in connection with the deployment of the Capture Material. They may be retained for as long as necessary for this purpose; this includes transfer to legal successors of the photographer/filmmaker.

I confirm that my (financial) compensation claims for the rights granted in this Photography Permission | Property Release have been settled. The compensation, which I agree to and hereby confirm, settles all claims of the owner and other rights holders. I confirm that this declaration is binding on my heirs, legal successors or other persons who assert an interest in the Property, and that I am authorized and able to make this declaration. This declaration is irrevocable, valid worldwide and for an unlimited period, and is subject to the laws of the Federal Republic of Germany, excluding conflict of laws provisions.

I certify that I am at least 18 years of age, fully legally competent, and authorized to make this declaration, to grant all rights with respect to the Property, and to legally bind other persons who hold or claim rights to the Property.
